OFFICIAL RULES PHOTO CONTEST “DISCOVER GAETA”

Art. 1 – Promoter

The contest is organized by ScopriGaeta.it, with registered office in Via del Colle, Contrada Canali, 1 1trav,dx Tax code/VAT IT03305780599. The initiative is hosted and managed on the web platform: scoprigaeta.it.

Art. 2 – Type and Purpose (Exclusion of Presidential Decree 430/2001).

The initiative does not fall under the discipline of prize contests (pursuant to Article 6 paragraph 1 of Presidential Decree 430/2001) because:

1. The prizes are in the nature of consideration for services rendered (assignment of copyright on the winning photographs for promotional purposes in the area) and not mere handouts.
2. The initiative has artistic, cultural and territorial enhancement purposes for the city of Gaeta.
3. The selection of winners is based on artistic merit and popular approval, with no method of drawing lots.

Art. 3 – Duration of the Contest

The contest will be held according to the following schedule:

• Photo submission opening: December 10, 2025.
• Public voting opening: December 12, 2025.
• Photo submission and voting deadline: Jan. 6, 2026 (11:59 p.m.).
• Ranking check and proclamation: Within days after closing.

Art. 4 – Theme of the Contest

Participants are invited to upload photographs that enhance the Gaeta area. Eligible subjects include, but are not limited to:

• Tourist attractions and monuments.
• Luminaries and city events.
• Landscapes, sea and characteristic views.

Art. 5 – Modalities of Participation

Participation is free of charge and is open to all users over 18 years of age. To participate, the user must fill out the appropriate form on the dedicated page scoprigaeta.it/partecipa-al-contest. Each participant may submit an unlimited number of photographs. Photos must be original, the exclusive property of the author, not covered by third party rights and free of invasive logos, watermarks or overlay signatures.

Art. 6 – Moderation and Technical Jury.

All uploaded images will undergo prior moderation (“Approval”) before being published in the gallery. Moderation and supervision are by the Scopri Gaeta Staff assisted by an assigned Professional Photographer. Images will be unquestionably discarded:

• Offensive, vulgar, inciting hatred, or infringing on the privacy of others.
• Blatantly downloaded from the Internet or not original.
• Technically unsuitable (e.g., low resolution, out of focus, off topic).

Art. 7 – Voting System and Fraud Security.

Voting is done electronically open to the public via the web platform. Users can express a positive preference (“Like”) or discard the image (“Pass”). To ensure the regularity of the competition and the principle of unambiguous voting, the system adopts advanced security measures:

1. Device Recognition: Use of Device Fingerprinting technologies and Technical Session Cookies.
2. IP tracking: Recording IP address in anonymized and encrypted form.
3. Automatic Blocking: The system automatically inhibits subsequent voting attempts for the same photo from the same user/device.

The Organizer reserves the unquestionable right to conduct system log checks and cancel/remove votes that show anomalies attributable to the use of bots, automated scripts, VPNs or other circumvention systems.

Art. 8 – Ranking and Awards

The ranking is visible in real time (“Live”) on the website. At the end of voting (January 6, 2026), the top 5 ranked photos, after technical verification of regularity and absence of fraud, will be awarded the following prizes in order of finish:

• 1st Runner-up: A stay for two at the Sapore di Mare B&B
• 2nd Runner-up: One beach entry at Aeneas Landing.
• 3rd Runner-up: A spa treatment for two at the Mirasole Hotel Spa
• 4th Runner-up: A day of boating at Oltremare Charter
• 5th Place Winner: Dinner for two at Kè Eat Restaurant

Prizes are intended as consideration for the transfer of rights to use the image and as recognition of personal merit. They are not convertible into cash or transferable to third parties without the consent of the Organizer.

Art. 9 – Copyright, Use and Indemnity.

By entering the contest and uploading photographs, the author:

1. Declares and warrants that he/she is the exclusive owner of the copyright in the work and that it does not infringe any third party’s rights.
2. Releases the Organizer from any liability, claim, or demand made by third parties (including portrayed persons), assuming full civil and criminal liability(Manleva).
3. In case of winning, he/she assigns to the Organizer the non-exclusive, free and territorially unlimited right to use, reproduce and publish the image on web channels, social networks and printed promotional material related to the activity of “Scopri Gaeta”, mentioning where possible the name of the author.

Article 10 – Processing of Personal Data

Personal data of participants and technical data of voters (e.g. IP Address, Device Footprint) are processed in compliance with EU Regulation 2016/679 (GDPR). The full information is available in the Privacy section of the website. It is specified that technical voting data is processed on the basis of Legitimate Interest for the sole purpose of ensuring the cybersecurity and regularity of the contest, and will be deleted upon completion of post-contest verifications.

Art. 11 – Acceptance

Participation in the contest implies full and unconditional acceptance of these Rules and Regulations. The Court of the place of residence of the Organizer shall have jurisdiction in any dispute.
